  1. Introduction

FEN Perfumes (www.fenperfumes.com) is a website (the “Website”) operated by FEN Aroma Pte Ltd (Singapore Company Registration) (the “Website Owner”). The Website Owner, including subsidiaries and affiliates (or “we” or “us” or “our” or “the company”) provides the information contained on this Website or any of the pages comprising the Website to visitors (“Visitors”) (cumulatively referred to as “you” or “your” hereinafter) subject to the terms and conditions set out in these Website terms and conditions, the privacy policy and any other relevant terms and conditions, policies and notices which may be applicable to a specific section or module of this website. Please read this agreement carefully. By browsing, accessing or using this website or by using any facilities or services made available through it or by transacting through or on it, you are agreeing to the terms and conditions that appear below (all of which are called the “Agreement”). This Agreement is made between you and us. This agreement also covers any Social Media Accounts, Groups and/or pages which you are invited to and/or made member of.

 

  1. Website Availability
  • FEN Perfumes may suspend the Website for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades, and shall not be liable to you for any such suspension.
  • FEN Perfumes reserves the right to make any changes to the Website or to discontinue any aspect or feature of the Website without notice.
  • In the event that FEN Perfumes, in its sole discretion, considers that you are making any illegal and/or unauthorised use of the Website, and/or your use of the Website is in breach of these Terms, FEN Perfumes reserves the right to take any action that it deems necessary, including terminating without notice your use of the Website and, in the case of illegal use, instigating legal proceedings.
  1. Your Status

By placing an order to purchase Products (Order) through the Website, you warrant that:

  • You are legally capable of entering into binding contracts; and
  • You are at least 18 years old; and
  • Have sole intention of purchasing for sales, re-distribution and/or personal use.
  1. The Contract Between You and FEN Perfumes
  • After placing an Order, you will receive an email from FEN Perfumes acknowledging that FEN Perfumes has received your order. Please note that this does not mean that your Order has been accepted. Your Order constitutes an offer to FEN Perfumes to buy a Product via the Website. All orders are subject to acceptance by FEN Perfumes, and FEN Perfumes will confirm such acceptance to you by sending you an email that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract between FEN Perfumes and you (Contract) will only be formed when the relevant Partner sends you the Dispatch Confirmation.
  • Each Contract relates only to those Products whose dispatch FEN Perfumes has confirmed in the Dispatch Confirmation. FEN Perfumes shall not be obliged to supply any other Products which may have been part of your Order until the dispatch of such Products has been confirmed by way of a Dispatch Confirmation.
  • Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible, including but not limited to office movement. FEN Perfumes will do its best,but not subjected to, provide dispatch within seven[5] – ten[10] working days upon order confirmation.
  • Should there be any technical errors, the Company will do its best to resolve the matter soonest.  However, the Company will not necessarily be answerable to you for any of their actions.
  1. Credit Card Payment

In a credit card transaction, you must use your own credit card. We will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user.

  1. Trademarks

The trademarks, names, logos and service marks (collectively “trademarks”) displayed on this website are registered and unregistered trademarks of the Website Owner and the suppliers of the products listed on the Website. Nothing contained on this website should be construed as granting any licence or right to use any trademark without the prior written permission of the Website Owner.

  1. External Links

External links may be provided for your convenience, but they are beyond the control of the Website Owner and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk. When visiting external links, you must refer to that external website’s terms and conditions of use.

  1. Specific Use

You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law and you hereby INDEMNIFY the Website Owner against any loss, liability, damage or expense of whatever nature which the Website Owner or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.

  1. Product and Descriptions

FEN Perfumes and its affiliates attempt to be as accurate as possible. However, FEN Perfumes does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by FEN Perfumes itself is not as described, your sole remedy is to return it in unused condition. FEN Perfumes will ensure that all products distributed are valid, good for use and sent out in its best condition at time of dispatch and will not be responsible for any third party use, covering all but not only limited to allergies, expiry and damaged packaging. It is your responsibility to check the validity and/or packaging of the products should you purchase from the Company and re-distribute through sales,gifts and/or specific use. FEN Perfumes shall not be held responsible for any problems arising from this.

  1. FEN Perfumes Refund Policy

Products returned by you because of a defect will be exchanged with the exact or similar value item, excluding a refund of any standard delivery charges for sending the item to you and the cost incurred by you in returning the item to us.

Customer bears responsibility for the goods upon signing. If a customer believes that a parcel has been tampered with, please refuse to sign for the goods and notify FEN Perfumes.

All FEN Perfumes’ customers will not be allowed to exchange and/or swap complimentary products to fit their needs.

Should any item be unavailable after successful payment, The Company will refund in full via PayPal or bank transfer for the unavailable item only. Customers will have to place a new order to have the unavailable item replaced, if desired.

  1. Disclaimer of Liability

You expressly agree that use of the Website is at your own risk. Neither FEN Perfumes, nor its affiliates, nor any of their officers, directors, or employees, agents, third-party content providers, merchants, sponsors, licensors (collectively, “Providers”), or the like, warrant that the Website will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of the Website, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through FEN Perfumes. This site is provided by FEN Perfumes on an as “as is” and “as available” basis. FEN Perfumes makes no representations or warranties of any kind, express or implied, as to the operation of the site, the information, content, materials or products, included on this site. To the full extent permissible by applicable law, FEN Perfumes disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. FEN Perfumes will not be liable for any damages of any kind arising from the use of this site, or from any products purchased from this site, including but not limited to direct, indirect, incidental, punitive and consequential damages. No oral advice or written information given by FEN Perfumes nor its affiliates, nor any of their officers, directors, employees, agents, providers, or the like, shall create a warranty or legal obligation; nor shall user rely on any such information or advice.

  1. User of the Website

The Website Owner does not make any warranty or representation that information on the website is appropriate for use in any jurisdiction (other than Singapore). By accessing the website, you warrant and represent to the Website Owner that you are legally entitled to do so and to make use of information made available via the website.

  1. Visitor Registration

Visitors will need to register with the Website in order to use some of the services or features made available on this Website. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. Should any of your registration information change, please notify us immediately via our Contact Us. We may change registration requirements from time to time.

These website terms and conditions constitute the sole record of the agreement between you and the Website Owner in relation to your use of the website and its social media platforms made available to you. Neither you nor the Website Owner shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these website terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and the Website Owner in respect of your use of the website.

Alteration

The Website Owner may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

Conflict

Where any conflict or contradiction appears between the provisions of these website terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the website shall prevail in respect of your use of the relevant section or module of the website. Cession

The Website Owner shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of any relevant terms and conditions, policies and notices to any third party. But there is no refund if user decides to terminate.

Severability

All provisions of any relevant terms and conditions, policies and notices are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as pro non scripto and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect.

Applicable

This site is created and controlled by FEN Perfumes in Singapore. As such, the laws of Singapore will govern these disclaimers, terms and conditions, without giving effect to any principles of conflicts of laws. FEN Perfumes reserves the right to make changes to its site and these disclaimers, terms and conditions at any time. User hereby irrevocably and unconditionally consents to submit to the exclusive jurisdiction of the courts of Singapore for any litigation arising out of or relating to use of or purchase made through FEN Perfumes (and agrees not to commence any litigation relating thereto except in such courts), waives any objection to the laying of venue of any such litigation in the Singapore Courts and agrees not to plead or claim in any Singapore Court that such litigation brought therein has been brought in an inconvenient forum.
